Murphy & Landon
If a driver hit you while walking or riding, start with your health.
Then preserve the scene information that can help you understand what happened and what a case review may involve.
If a driver hit you while you were walking or riding a bicycle, get medical help and make safety the first priority. When you can, preserve the information that may disappear quickly: the location, vehicle and driver details, witnesses, photographs, and report information. You can then get a straight answer about what a Delaware case review may involve.

What should I do right after the crash?
Get emergency assistance or medical care if needed. If it is safe, identify the driver and vehicle, ask witnesses for contact information, and note the exact location. Keep photographs, report information, clothing or equipment that may be relevant, and medical paperwork. If someone else is helping you, ask them to record what they can.
What evidence can be different in a pedestrian or bicycle accident?
The roadway layout, crosswalks, signals, lighting, sightlines, direction of travel, vehicle information, and witness accounts may be especially important. Preserve the facts you can observe; do not assume you know who was at fault. A case review can help identify what other information may be useful.
If an insurer contacts me
Write down the caller’s name, company, claim number, and request. It is reasonable to ask for time to understand a recorded statement, medical authorization, or settlement proposal before agreeing to it. If you are unsure, get advice.
If a family member was killed
Start with the family’s immediate needs and preserve the available information. A conversation can help you understand what may need to be reviewed and what the next step could be. It cannot promise a result.
