Liability Questions After a School Bus Crash in Wilmington, DESchool Bus Runs Red Light, Injuring Children and Woman

When a school bus causes a wreck, questions of liability can become more complicated than a standard two-vehicle crash, since a school district, a private busing contractor, or the driver individually may all bear some responsibility depending on who employed the driver and maintained the vehicle.

Children involved in a bus crash can suffer injuries that can range from bumps and bruises to more serious trauma, especially since school buses often lack the same seatbelt and restraint systems as passenger vehicles.

If the bus was operated by or on behalf of a government entity, Delaware’s government claim requirements may apply, which can include shorter deadlines and specific notice procedures before a claim can move forward, a detail that makes early legal guidance particularly useful in cases involving public transportation.

A personal injury lawyer can help identify whether the bus was publicly or privately operated and pursue claims against the appropriate party or parties, including any liability tied to the driver running the red light.

At Murphy & Landon, we are available to help families and individuals affected by a bus crash understand their legal options. Our team can explain how Delaware’s rules for claims against a government or private bus operator might apply.

If your child or someone you know was hurt in a crash, reaching out early can help protect important deadlines. You can contact our team at Murphy & Landon at (302) 472-8100 to learn more.
