The Delaware Courts are Entering “Phase 3” – What Does that Mean?

It is anticipated that on June 1, Delaware courts will move to Phase 3 of the reopening plan.  Phase 3 permits increased public access to the courthouse subject to temperature checks, social distancing, mask-wearing, and increased capacity limits.  After a hiatus beginning in March 2020, jury trials are anticipated to resume in Phase 3.  It is also anticipated that a backlog of criminal trials will take priority over pending civil cases, but it is exciting that progress is being made and justice will be more accessible.
