Pedestrian Accidents in Delaware
Pedestrian crashes are a tragic yet common occurrence across Delaware. Cities and rural areas alike have seen a troubling rise in these incidents, especially at night or in areas without proper lighting or sidewalks. Unfortunately, hit-and-run cases like the one that claimed the life of Cheryl Hiett are among the hardest for families to understand and recover from, both emotionally and legally.
Delaware’s Office of Highway Safety reports dozens of pedestrian fatalities each year. Many of these victims are older adults or individuals crossing poorly marked roads. Accidents can happen for several reasons: distracted driving, low visibility, speeding, or failure to yield the right-of-way.
Victims of pedestrian crashes, or their surviving family members in fatal cases, may be entitled to compensation through a wrongful death or personal injury claim. A skilled Delaware pedestrian accident attorney can help investigate the crash, track down hit-and-run drivers, and hold responsible parties accountable. Lawyers often work with crash reconstruction experts, gather surveillance footage, and speak with witnesses to build a strong case.
Compensation can include coverage for medical bills, funeral costs, lost income, pain and suffering, and emotional distress. In hit-and-run cases, even if the driver isn’t identified, victims may still be able to recover through uninsured motorist coverage or other legal options. A Wilmington personal injury lawyer can explain those alternatives.
It’s important to act quickly. In Delaware, wrongful death claims must be filed within two years of the death, and gathering evidence early improves the chances of a successful outcome.
