What Steps Should Families Take Following a Fatal Vehicle Accident in Wilmington, DE?
Following a fatal vehicle accident in Wilmington, DE, surviving family members should first focus on preserving important records, obtaining the official crash report, and documenting expenses connected to the death.
Qualifying relatives may be able to file a wrongful death lawsuit under Delaware law to seek certain damages, which can include final medical expenses, funeral costs, lost financial support, and other losses.
Once immediate needs are addressed, preserving evidence can help establish how the collision occurred and who may have been responsible.
Police reports, photographs, witness statements, vehicle information, medical records, and available surveillance footage may provide useful details. Families should also keep funeral invoices, medical bills, insurance correspondence, financial records, and other documents that show the losses connected to the death.
Because fatal vehicle cases can involve multiple insurance and legal issues, determining which parties and policies may be involved can require additional review. The circumstances of the collision, available evidence, insurance coverage, and relationship between the deceased and surviving relatives may all affect how a potential wrongful death claim is evaluated.
As the family moves through the legal and insurance process, a wrongful death lawyer can review the available information and explain potential options. An attorney can communicate with insurance companies, gather relevant records, assist with preserving evidence, and handle required legal filings.
