Wilmington, DE — Newark Man Killed in DUI Red-Light Collision on Concord Pike

Wilmington, DE (April 20, 2026) — A Newark man has tragically lost his life following a high-impact collision on Concord Pike on Saturday, April 18. Delaware State Police responded to the scene at the intersection of Concord Pike (Route 202) and Rocky Run Parkway at approximately 2:20 p.m.

The investigation determined that a 72-year-old Newark man was operating a Toyota Prius and attempting to turn left onto Concord Pike with a green arrow signal. As he entered the intersection, his vehicle was struck by a southbound Ford Taurus that failed to stop at a red light. The driver of the Prius was rushed to a local hospital, where he was later pronounced deceased.

The driver of the Taurus, identified as 35-year-old Michelle Palazzolo of Wilmington, was also hospitalized with non-life-threatening injuries. Palazzolo has been arrested and faces several charges, including second-degree vehicular manslaughter, DUI, failure to stop at a red light, and operating a vehicle without required insurance.

The incident remains under investigation.

We extend our sincere condolences to the family of the man who lost her life in this incident.

What are the Legal Rights of Families After a Fatal DUI Accident in Delaware?

Losing a loved one in a crash caused by an impaired driver is a profound tragedy that often leads to complex legal and insurance challenges. In Delaware, when a driver is arrested for DUI and vehicular manslaughter, the family’s path toward justice involves both the criminal court system and a civil wrongful death claim.

In Delaware, the family of a victim killed by a negligent driver can pursue two types of legal actions. A Wrongful Death claim allows surviving family members to seek compensation for the loss of financial support, funeral expenses, and the loss of companionship. A Survival Action allows the estate to seek damages for the pain and suffering the deceased experienced from the moment of impact until their passing. Because this crash involved a red-light violation and a subsequent hospital transport, documenting the timeline of the “major impact” is essential for proving these damages.

When a driver is charged with vehicular manslaughter and DUI, it can significantly strengthen a civil case. Under Delaware law, a conviction for these crimes serves as “negligence per se.” This means the court may automatically find the driver liable for the accident, shifting the legal focus from who caused the crash to how much compensation the family is owed.

In this case, the investigation revealed that the driver of the Taurus failed to have the required insurance. In these cases, the family must look to the victim’s own Uninsured/Underinsured Motorist (UM/UIM) coverage. This part of a Delaware auto policy is designed to step in and pay for damages when the at-fault party is broke or lacks insurance. A legal professional can review the victim’s policy to ensure that every available dollar of coverage is accessed to pay for medical and funeral costs.

Navigating a wrongful death claim is an immense emotional and legal burden. Contact a Delaware wrongful death lawyer today to protect your family’s rights and ensure that the lack of insurance on the part of the at-fault driver doesn’t prevent you from receiving justice.
