What Happens If the At-Fault Driver Is Uninsured in a Crash in Rehoboth?
When a crash occurs in Delaware, and the at-fault driver does not have insurance, injured victims may still have options for recovering compensation. Although uninsured drivers create additional challenges, several potential sources of coverage may help pay for medical care and other losses.
One common source is Uninsured Motorist (UM) coverage, which is included in many auto insurance policies. This coverage can help pay for medical expenses, lost wages, and other damages when the responsible driver does not carry liability insurance. In many cases, UM coverage applies to both drivers and motorcyclists who are injured by uninsured motorists.
Victims may also rely on their personal health insurance to cover immediate medical treatment, including emergency care, hospital stays, surgeries, and rehabilitation. Health insurers sometimes seek reimbursement if a settlement is later obtained.
In some situations, legal action against the uninsured driver may also be an option. Although recovering compensation directly from an uninsured individual can be difficult, an attorney may investigate whether other parties share liability, such as vehicle owners, employers, or other drivers involved in the crash.
