Why Vehicle Fires Complicate Injury Claims in Millsboro, DE
When a vehicle catches fire after a crash, the physical evidence needed to determine fault can be damaged or destroyed within minutes. Fire investigators usually work alongside crash reconstruction teams to figure out whether the fire started from impact damage, a fuel system failure, or another mechanical issue.
Based on Delaware’s modified comparative negligence rule, a person can still recover damages as long as they are found less than 51% at fault for the crash. However, it is important to understand that their compensation is reduced by their own percentage of responsibility.
Fault in a multi-vehicle wreck that involves fire and entrapment can be difficult to sort out and insurance companies tend to move quickly to inspect or dispose of damaged vehicles before a full review takes place.
When a car accident leads to a fire, injured individuals not only have to deal with the typical car accident injuries, but can also have to deal with burns, smoke inhalation, or injuries sustained while trying to escape a vehicle.
In these cases, it matters to get statements and photos preserved early, and an auto accident lawyer can send formal requests to insurers asking that a damaged vehicle be kept intact rather than scrapped or repaired before it can be examined.
