Who Can File a Wrongful Death Claim in Newark, DE?

When a married person dies in a crash, the surviving spouse is usually the first person eligible to file a wrongful death claim. Delaware law allows spouses to seek damages related to loss of companionship, financial support, and household contributions. A spouse may also pursue compensation for funeral expenses and other costs connected to the death.
If the victim had dependent children, those children may also qualify to pursue a claim. Courts may consider whether the children relied on the victim for financial support, guidance, or daily care. Minor children and financially dependent adult children can both have grounds to seek compensation.
When no surviving spouse or children exist, the victim’s parents may have the right to file a wrongful death claim. Delaware law allows parents to pursue damages when no closer qualifying family member is available. These claims may involve both financial losses and the emotional impact of losing a child.
A wrongful death lawyer can review the details and explain what legal options may apply to your family. Legal guidance may help clarify filing deadlines, required paperwork, and the evidence needed to support a claim.
