Who Can File a Wrongful Death Claim in Smyrna, DE?

The personal representative is usually named in the deceased person’s will or estate plan. If no representative was named, the court can appoint someone to serve in this role. The representative handles all legal steps, though any recovery must go to the eligible beneficiaries.
Delaware law defines eligible beneficiaries as the surviving spouse, children, and parents of the deceased. If the person who died had no spouse or children, the parents may bring the claim. Siblings and other relatives generally do not have standing to recover unless they meet specific dependency rules.
When no immediate family members survive, the claim may still move forward. The personal representative can pursue the case on behalf of the estate itself. Any money recovered would then pass to more distant heirs under Delaware’s estate laws.
Delaware sets a strict two-year time limit for bringing a wrongful death claim. This deadline starts on the date of the person’s passing, not the date of the accident. Missing this deadline can mean losing the ability to seek recovery completely.
Insurance companies often move quickly after a fatal crash to limit their financial exposure. Adjusters may contact family members and offer settlements before the full scope of the loss is clear. You should speak with a wrongful death attorney before signing anything or accepting early offers.
