What Compensation Can a Family Seek After a Child Is Hit by a Vehicle in Delaware?Child Struck by Vehicle at E 12th St & N Walnut St

When a child is struck by a vehicle in Delaware, the family may be eligible to seek several types of compensation on the child’s behalf. These can include coverage for medical expenses, rehabilitation costs, and the long-term impact the injuries may have on the child’s development and quality of life. Delaware law allows a parent or legal guardian to file a personal injury claim on behalf of a minor, and the compensation available depends on the severity of the injuries and the circumstances of the crash.

Medical expenses form the foundation of most claims involving injured children. Emergency treatment, hospitalization, surgical procedures, follow-up care, and physical therapy can all generate significant costs after a serious pedestrian accident.

Delaware also recognizes non-economic damages in personal injury cases involving children. These include compensation for pain and suffering, emotional distress, and the loss of enjoyment of life that serious injuries can cause. Courts take into account the child’s age and the potential long-term effects of the injuries when evaluating these claims.

A personal injury lawyer can help families understand Delaware’s laws as they apply to child pedestrian accidents, identify all parties who may bear responsibility, and explain what compensation options may realistically be available.

At Murphy & Landon, we have years of experience helping Delaware families navigate personal injury claims involving children and serious pedestrian accidents. We can review the details of your situation, explain how Delaware law applies, and outline what compensation may be available for your child’s injuries.
