Pedestrian Accidents and Injury Claims in Delaware
Pedestrian collisions continue to be a serious safety concern, particularly during nighttime and early morning hours when visibility is reduced. Many pedestrian crashes occur when drivers fail to yield at crosswalks or intersections, make turns without adequately scanning for foot traffic, or travel at unsafe speeds in areas where pedestrians are present.
Driver distraction involving mobile devices or vehicle systems is another frequent factor, as is impairment from alcohol, drugs, or fatigue. In some cases, limited lighting, obstructed sightlines, or roadway design issues can further increase the risk of a pedestrian being struck.
Since pedestrians are unprotected in collisions with motor vehicles, injuries are often severe, and in many cases, they even tend to be fatal. Common injuries include traumatic brain injuries, skull fractures, spinal cord damage, internal bleeding, broken ribs, pelvic trauma, and serious fractures to the legs or arms.
Potential damages may include medical costs incurred before death, funeral and burial expenses, lost income and future financial support, and loss of companionship or guidance for surviving relatives. Non-economic damages, such as pain and suffering or the emotional consequences of the loss, may also be recoverable depending on the circumstances and the evidence developed during the investigation.
